These Terms govern your use of Onyx Performance Academy, operated by Onyx Performance Systems. By creating an account or purchasing a course, you agree to these Terms.

Your account

You are responsible for maintaining the confidentiality of your account. You must not share your account with others. One account is permitted per person. We reserve the right to suspend accounts that violate these Terms.

Courses and access

One-time purchases. Certification prep courses are sold as one-time purchases with lifetime access. Access is tied to your account and is non-transferable.

Subscriptions. Coach Education and Athlete Education content is available via subscription. Subscriptions renew automatically at the end of each billing period unless canceled. You retain access through the end of the period you have paid for.

Free content. Some courses, including Why We Test, are provided free of charge. We reserve the right to change the availability of free content with reasonable notice.

Acceptable use

You may access course content for your own personal or professional education. You may not: reproduce, distribute, or resell course content; share login credentials; screen-record or redistribute video content; use the platform to train AI systems or create competing products.

Intellectual property

All course content — including videos, text, quizzes, and assessments — is the property of Onyx Performance Systems and is protected by copyright. Purchasing a course grants you a personal, non-transferable license to access that content. No ownership is transferred.

Certification disclaimer

Onyx Performance Academy is an independent education provider. Our courses are not produced, endorsed, or affiliated with NCSF, NSCA, NASM, or any other certifying body. Passing our practice materials does not guarantee exam success. Check the official certifying body's requirements before registering for any exam.

Limitation of liability

Onyx Performance Academy is provided "as is." We do not warrant that the platform will be error-free or uninterrupted. To the maximum extent permitted by law, Onyx Performance Systems is not liable for indirect, incidental, or consequential damages arising from your use of the platform.

Changes to these Terms

We may update these Terms. We will notify you of material changes by email or by posting a notice on the platform. Continued use after notice constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Florida, United States. Disputes will be resolved in the courts of Miami-Dade County, Florida.
